The Protecting Patient Access to Emergency Medications Act of 2017

The Protecting Patient Access to Emergency Medications Act of 2017. This act now allows the use of “standing orders” in administration of controlled substances, up till this act’s passing the use of standing orders for these classes of medications was in violation of the Controlled Substance Act. This act also allows EMS agencies to apply for their own DEA Registration for the administration of these medications. It also requires EMS agencies to maintain records for all deliveries, administrations and waste of medications as outlined in the Controlled Substance Act.

Code of Federal Regulations Section 1301.75

The Code of Federal Regulations Section 1301.75 states that all controlled substances (Schedule II,III, IV and V) must be stored in a securely locked, substantially constructed cabinet.

Code of Federal Regulations Section 1301.76

The Code of Federal Regulations Section 1301.76 states who is bared from being employed for the purposes of handling or administering controlled substances. It also spells out the requirements for reporting of theft or diversion of controlled substances under the control of the applicant.
